Rusticated UNIABUJA Student Sues University To Court, Demands N50M Damages

Oladeru Samson Olamilekan, an undergraduate student at the University of Abuja, has taken legal action against the university’s administration after being expelled. Olamilekan and his fellow student, Cyprian Igwe, faced harassment and expulsion for organizing a meeting and protest against the recent increase in school fees. Igwe had encouraged Olamilekan and other students to participate in the demonstration via a message on their WhatsApp group.

According to court documents, Olamilekan is seeking the protection of his fundamental rights to personal liberty, fair hearing, and freedom of movement, as guaranteed by the Constitution of the Federal Republic of Nigeria and the African Charter on Human and Peoples Rights Ratification and Enforcement Act. His lawyer, Tope Temokun, filed the lawsuit on his behalf.

The respondents in the lawsuit, numbered from 1 to 8, include the University of Abuja, its Council, Senate, Vice-Chancellor Professor Abdul-Rasheed Na’allah, Registrar Yahaya Mohammed, Deputy Registrar of Academics Alkasim Umar, Chief Security Officer Ibrahim Abdullahi Burga, and OC Intelligence Adamu Abubakar.

In the lawsuit filed on June 6, 2023, Olamilekan seeks a court declaration that his arrest and detention at the university’s Intelligence Unit on May 26, 2023, from 9 a.m. to 6 p.m., by Adamu Abubakar (the 8th respondent) violated his fundamental right to personal liberty without any just cause or legal grounds.

Additionally, Olamilekan requests an immediate reinstatement as a legitimate student of the University of Abuja, along with all associated rights and privileges. He also seeks a perpetual injunction to prevent the respondents, their agents, or anyone acting on their behalf from further arresting or detaining him, or implementing the letter of rustication issued on May 26, 2023.

Furthermore, Olamilekan demands that the court orders the respondents, jointly and severally, to pay him a sum of Fifty Million Naira (N50,000,000.00) as general and exemplary damages for the violation of his fundamental rights mentioned earlier.
