APM’s Petition Against Tinubu Incompetent- Tribunal

The Presidential Election Petition Court (PEPC) in Abuja has deemed the case brought forth by the Allied Peoples Movement (APM) to invalidate President Bola Tinubu’s election as incompetent.

The court ruled that the issues raised by APM in their petition pertained to pre-election matters, which fall under the jurisdiction of the Federal High Court. Justice Haruna Tsammani, the panel’s chairman, upheld the preliminary objections raised by all respondents regarding the competence of the petition.

Justice Haruna explained that since the petition revolved around President Tinubu’s qualification for the presidential election held on February 25, the APM should have taken their case to court within 14 days after Tinubu’s nomination by the All Progressives Congress (APC). He further asserted that since this matter concerned a pre-election issue, the APM did not have the legal standing (locus standi) to challenge Tinubu’s nomination.

Additionally, Justice Tsammani noted that the Supreme Court had previously established that one political party cannot challenge the nomination made by another political party. He pointed out that the 1999 Constitution, as amended, contains provisions in sections 131 and 237 for candidate qualification or disqualification in an election. The primary concern of APM appeared to be the alleged invalid nomination of Tinubu’s running mate, Kashim Shettima.
