Tribunal Rejects 10 Out Of 13 Witnesses Presented By Obi

The Presidential Election Petitions Tribunal announced that it dismissed 10 out of the 13 witnesses brought forth by Peter Obi, the Presidential candidate of the Labour Party.

Justice Haruna Tsammani, who presided over the judgment of Obi’s petition, made this declaration on Wednesday.

Tsammani explained that Obi had called 13 witnesses, identified as PW1 to PW13. He noted that among these 13 witnesses, only three had their statements under oath filed alongside the petition. The remaining 10 witnesses, according to the Justice, were summoned, and their statements under oath were only submitted after the hearing had begun.

Tsammani emphasized that according to the Nigerian constitution’s section 285, section 137(7) of the Electoral Act 2022, and other relevant provisions, every witness statement under oath must be included with the initial petition. He further stated that once the 21-day period for filing an election petition has passed, the content of the petition cannot be altered, citing Supreme Court precedent.

The Justice added that no additional statements under oath can be submitted after the specified filing window closes since the respondents would not have the opportunity to respond. Tsammani also noted that the petitioners were aware of the legal requirement for filing witness statements under oath but proceeded to present 10 witnesses without their corresponding statements filed alongside the petition.
