
The Supreme Court has overturned the judgments of both the Court of Appeal and the Federal High Court, which had removed Senator Samuel Anyanwu as the National Secretary of the People’s Democratic Party (PDP).
A five-member panel of the apex court ruled on Friday that the position of National Secretary falls under the internal affairs of the PDP and is not subject to judicial intervention.
Delivering the lead judgment, Justice Jamilu Tukur struck out the trial court's October ruling and set aside the Court of Appeal's majority decision from December, which had upheld Anyanwu’s removal. Instead, the Supreme Court endorsed the minority judgment of Justice Ekanem, who had ruled that the trial court lacked jurisdiction over the matter.
Furthermore, the court held that the plaintiff, Aniagu Emmanuel, lacked the legal standing to file the suit, as he failed to demonstrate how the appointment of the PDP National Secretary personally affected him.
