U.S. immigration authorities stress that consular officers have full access to an individual’s immigration history, making past violations easily detectable and penalties unavoidable. Officials also highlight that ignorance of visa rules is not an excuse, as travelers are fully responsible for adhering to the terms of their stay. “If you overstay your U.S. visa, you could face a permanent ban on traveling to the United States. Consular officers have full access to your immigration history and will know about past violations. There is no such thing as an “honest mistake” – it is your responsibility to use your visa correctly,” the tweet reads. Under U.S. immigration law, individuals who overstay their visa for more than 180 days but less than a year may face a three-year re-entry ban. Those who remain in the country for a year or longer risk a 10-year ban, while repeat offenders or those with serious violations could be barred for life.
